01Introduction
These Terms & Conditions ("Terms") govern your access to and use of the website https://cpaaviations.com and all of its pages (the "Website"). The Website is operated by CPA Aviations India Private Limited, a private limited company incorporated under the laws of India (CIN: [CIN]), with its corporate office at 2A, Pvt No. 2A/8A, Third Floor, Municipal No. 63, Rama Road, Najafgarh Road Industrial Area, New Delhi 110015, India ("CPA Aviations", "we", "us" or "our").
By accessing or using the Website, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website. If you use the Website on behalf of an organisation, you confirm that you are authorised to accept these Terms on its behalf.
These Terms are an electronic record under the Information Technology Act, 2000 and the rules made under it, and do not require any physical or digital signature.
02Eligibility
You must be at least 18 years of age and competent to enter into a contract under the Indian Contract Act, 1872 to use the Website.
03About the Website
The Website provides general information about CPA Aviations, our parent company, our leadership team and our service verticals, which include:
- Airport & Aviation Infrastructure Operations;
- Aviation Services & Support Operations;
- Aircraft Maintenance, Repair & Overhaul (MRO); and
- Trading & Supply of Aviation Equipment.
Website content is provided for general information only. It is not an offer, a quotation or a commitment to provide any service, and it does not mean that a particular service is available at any location or within any timeframe.
Services marked "Coming Soon" on the Website are under development and may not yet be available. Their descriptions set out the intended scope, which may change. Please contact us to confirm current availability.
04No Professional or Technical Advice
Nothing on the Website is technical, engineering, airworthiness, safety, regulatory, legal, customs, financial or other professional advice. Decisions about aviation operations, maintenance or equipment must be based on applicable regulations, approved manufacturer data and the advice of appropriately licensed personnel, not on Website content. Responsibility for the airworthiness and safe operation of any aircraft remains with its operator and with the persons and organisations approved for that purpose under applicable law.
05Engaging Our Services
- We provide services only under a separate written agreement, work order, purchase order or accepted quotation (a "Service Agreement") that sets out the scope, deliverables, timelines, fees and responsibilities of each party.
- Submitting the contact form, sending us an email or any other exchange through the Website does not create a contract and does not oblige us to provide any service.
- Quotations and proposals are valid only for the period stated in them and are subject to site assessment, resource availability and any required regulatory approvals.
- If these Terms conflict with a Service Agreement, the Service Agreement prevails for that engagement.
06Regulatory Approvals and Compliance
Many aviation activities are regulated in India and abroad, including airport and ground handling operations, aircraft maintenance, charter operations and the import and export of aviation equipment. Accordingly:
- Regulated services are performed only by CPA Aviations or by partners holding the licences, approvals, security clearances or certifications they require, and only after the necessary approvals are in place.
- Statements on the Website about alignment with the standards of the Directorate General of Civil Aviation (DGCA), the International Civil Aviation Organization (ICAO), the Bureau of Civil Aviation Security (BCAS) or equipment manufacturers describe our operating approach. They are not a statement that we hold any particular approval, certificate or licence. The approvals relevant to an engagement will be confirmed in writing in the Service Agreement.
- Timelines that depend on approvals from government authorities, airport operators, customs or other third parties are outside our control.
- Clients are responsible for providing accurate, complete and timely information, documents and access that we need to perform services and obtain approvals.
07Aviation Equipment Supply, Import and Export
Where we supply, import or export aviation machinery, tools, navigation and communication equipment, or safety and surveillance systems:
- Specifications, certifications, warranties, delivery, installation and commissioning are governed by the Service Agreement and the applicable manufacturer (OEM) terms. Product images and descriptions on the Website are for illustration only.
- Supply is subject to availability and to applicable import and export laws, including the Customs Act, 1962, the Foreign Trade (Development and Regulation) Act, 1992, India's SCOMET controls and, where relevant, export controls imposed by the country of origin.
- You agree to provide end-use and end-user information when we request it, and not to divert, re-export or use supplied items in breach of applicable law.
- Customs clearance timelines depend on the relevant authorities and are outside our control.
08Information About Our Parent Company
The Website includes information about our parent company, C P Arora Private Limited, including its history, directors, projects, work orders, clients and financial figures.
- C P Arora Private Limited is a separate legal entity. Unless it is expressly a party to a Service Agreement, it takes on no obligation or liability for services provided by CPA Aviations.
- Project values, work orders and financial figures relate to C P Arora Private Limited, apply to the periods stated and are provided as general background only. They may not reflect its current position.
- This information is not an offer, invitation or solicitation to invest in or lend to any company and must not be relied on for any investment or credit decision.
